How to Start a Title Search and Title Support Company for US Clients from Abroad (2026), Without Visiting: US LLC or C-Corp, EIN Without an SSN, Bank Account, ALTA Best Practices, GLBA Data Security, RESPA, Abstractor Licensing and Field Searchers

How a title search, title examination support or post-closing services firm outside the USA sets up a US company remotely to work for American title agents, attorneys and lenders: LLC or C-Corporation, EIN without an SSN or ITIN, a US business bank account without visiting, the services and pricing, access to county records and US field abstractors, ALTA Best Practices and vendor reviews, GLBA and the FTC Safeguards Rule, RESPA Section 8, state abstractor licensing and attorney states, E&O insurance, wire fraud, tax, and worked examples.

Every US home sale, refinance and commercial property deal needs a title search: a review of county records to confirm who owns the property and what mortgages, liens, judgments and taxes are attached to it. Title insurers and their agents rely on the search to issue a title insurance policy, and lenders will not fund without one.

A large share of that work is done outside the USA. Firms in Hyderabad, Chennai, Coimbatore, Cebu and Colombo run searches on county websites, prepare title commitments, type policies, record documents and handle post-closing follow-up for US title agencies, law firms and lenders. It is a mature, steady, process-driven business, and clients judge vendors on turnaround, accuracy and data security.

A US company makes it easier to sign US title agencies and get through their vendor reviews. This guide explains how to set one up remotely and the rules specific to the title industry.

In short: A non-resident can form a US LLC or C-Corporation without visiting, get an EIN without an SSN or ITIN, and open a US business bank account remotely. If your searchers work abroad, a foreign-owned single-member LLC usually owes no US federal income tax, but files Form 5472 each year. Title clients will review you against ALTA Best Practices, expect GLBA-grade protection of borrowers' non-public personal information, and often require E&O insurance. Never pay or accept referral fees for title business, which RESPA Section 8 prohibits. Searches support a licensed title agent's or attorney's work; check state abstractor licensing if you sell searches directly.

Pricing is usually per file, from a modest fee for a current-owner search to more for a full search or a commercial file, with 24 to 48 hour turnaround as standard. Some clients pay a monthly fee for a dedicated team.

Can you set it up without visiting the USA?

Yes:

  • Form the LLC or corporation online with a state, through a registered agent
  • Get the EIN without an SSN or ITIN: a foreign owner files Form SS-4, which the IRS processes manually
  • Open a US business bank account without visiting, at a bank or fintech that accepts foreign-owned companies
  • Subscribe to county and data portals in the company's name, paid with the company card
  • Sign vendor agreements and NDAs electronically

Expect four to eight weeks from order to a working bank account. See opening a US company without visiting and EIN for non-residents. Title support is easy for banks to understand; see the US business bank account guide.

US LLC or C-Corp?

US LLC formation for a title search company

A single-member LLC owned by a non-resident is disregarded for US tax. Where the searches and processing are done outside the USA, and there is no US office or staff, the fees are generally foreign-source and the LLC usually owes no US federal income tax. It files Form 5472 with a pro forma 1120 every year (penalty $25,000 if missed). See Form 5472 explained.

A Wyoming LLC with EIN is $249, or $348 with a bank account, then $121 a year.

US C-Corp formation for a title search company

A C-Corporation (21% federal tax) suits a firm that will use US field abstractors heavily, hire US staff, take on investors or sell the business later. It also keeps any US tax in the company, rather than with you personally, if part of the income becomes US-source. A Delaware corporation with EIN is $358, then $578 a year. See LLC vs Inc.

Access to county records, and US field searchers

The USA has more than 3,000 counties, and each keeps its own land records.

  • Many counties have online indexes and images, some free, some by paid subscription.
  • Title plants and data providers sell indexed records for many counties.
  • Some counties, or older records, are only available in person at the courthouse.

For those, offshore firms engage US field abstractors: independent searchers who visit the courthouse and send back copies.

US abstractors are US persons. Collect a Form W-9 from each, and file Form 1099-NEC for anyone paid $2,000 or more for payments made from 2026. See paying contractors.

There is a tax point here too. If part of each search is physically done in the USA by people working for you, part of your income may be US-source and effectively connected with a US business. Independent abstractors working for many firms are not usually your agents, but heavy reliance on US fieldwork is a reason to take advice, and possibly to choose a C-Corp. See effectively connected income.

ALTA Best Practices and vendor reviews

The American Land Title Association's Title & Settlement Best Practices are the standard US title agencies certify against, and lenders expect them. They cover licensing, escrow controls, privacy and information security, settlement procedures, title policy issuance, insurance and complaints. Agencies must manage their vendors under the same standards, so they will review you.

Expect a vendor questionnaire asking about:

  • access control: unique logins, multi-factor authentication, least privilege
  • physical security of your office and clean-desk rules
  • device controls: no USB storage, no personal email, no printing of files
  • encryption of data in transit and at rest
  • background checks and training for staff
  • incident response: how quickly you would notify the client of a breach
  • data retention and destruction

A written information security programme, signed confidentiality agreements with every employee, and evidence of training will put you ahead of most competitors. SOC 2 or ISO 27001 helps with larger clients.

GLBA and the FTC Safeguards Rule

Title insurers and agents are financial institutions under the Gramm-Leach-Bliley Act, and the borrowers' names, loan numbers, account details and Social Security numbers in title files are non-public personal information.

  • Title companies must protect that information and oversee their service providers. Your contract will require you to do the same.
  • For non-bank financial institutions under the FTC's jurisdiction, the FTC Safeguards Rule requires a written security programme, risk assessments, encryption, multi-factor authentication and, since May 2024, notifying the FTC of certain breaches affecting 500 or more people. Your clients will pass these duties on to you.

RESPA Section 8: no referral fees

The Real Estate Settlement Procedures Act applies to residential mortgage closings. Section 8 prohibits giving or accepting any fee, kickback or thing of value for referring settlement service business, and splitting fees except for services actually performed.

For a title support company, that means:

  • never pay title agency staff, loan officers or real estate agents for sending you files
  • no "marketing fees" or gifts that are really payment for referrals
  • price your services at fair value for work actually done

Violations carry fines, imprisonment and damages of three times the charge. The Consumer Financial Protection Bureau and state regulators enforce it, and the title industry has seen many cases.

Licensing: who can do what

  • Title insurance is issued by state-licensed underwriters through state-licensed title agents. As a support company, you work for them and do not issue policies.
  • A few states license abstractors who sell abstracts or searches; Nebraska, for example, requires abstracters to be licensed, and several other states regulate abstracts used for title opinions.
  • In attorney states, such as Georgia, South Carolina, Massachusetts and New York, attorneys play a central role in closings or certify title, and your searches support their opinions.

If you sell searches only to licensed agents and attorneys who rely on them under their own licences, you are usually outside these rules, but check before you sell searches directly to investors or consumers in a regulated state.

Errors and omissions, and limiting liability

A missed mortgage or judgment can cost a title insurer the full amount of the claim. Protect your business by:

  • carrying abstractor's or professional E&O insurance, which many clients require on your certificate
  • stating in your contract the search period and sources covered, and that the client's licensed examiner makes the final determination
  • limiting your liability to the fees paid, or to your insurance cover
  • keeping a record of every search: sources, dates searched, documents found

Wire fraud: stay clear of closing funds

Real estate closings are the top target for business email compromise in the USA. Fraudsters impersonate title companies and send buyers false wire instructions.

  • Your company should never handle closing funds or wiring instructions.
  • Use client email domains and portals only, and never change payment details by email.
  • Train staff to spot phishing, since a compromised vendor mailbox is a common way in.

Getting paid and paying the team

  • Invoice per file or monthly from the US company. Clients pay by ACH to your US account. See receiving payments from US clients.
  • Give clients a W-8BEN or W-8BEN-E for a foreign-owned single-member LLC, or a W-9 from a corporation. See W-8BEN-E vs W-8BEN.
  • If your searchers are employed by your home-country company, use an intercompany agreement and record related-party payments for Form 5472. Indian residents follow the ODI rules; see ODI and FEMA.

Sales tax

Title search and title support services are generally not subject to sales tax, but a few states tax certain information or abstract services. Check states where you sell directly to end users. See state taxes for foreign-owned companies.

Worked examples

These are illustrative examples, not client stories.

A title search firm in Hyderabad. Prasad's firm has 30 searchers working on online county records for title agencies in Florida, Texas and Ohio. It forms a Wyoming LLC under the ODI route, with an EIN and US bank account, and contracts with agencies through the LLC. The Indian company does the work under an intercompany agreement. For counties without online records, the LLC engages two US field abstractors, collecting W-9s and filing 1099-NECs. The firm passes each client's ALTA vendor review with a written security programme and E&O cover.

A post-closing team in Cebu. Grace's company handles recording follow-up and final policy typing for a US title agency group. It forms a US LLC to sign the master services agreement, which requires GLBA-grade safeguards, breach notice within 24 hours and no handling of funds. Staff use virtual desktops with no download rights.

A property report provider in Colombo. A Sri Lankan company sells ownership and encumbrance reports to US mortgage servicers and investors. It forms a Delaware C-Corp, as it plans to raise money for a data platform. Before selling reports directly to investors, it checks the abstractor licensing rules in the states it covers, and its terms state the report's scope and limit liability.

Common mistakes

  • Paying title agency staff for referrals, which breaches RESPA Section 8.
  • No written security programme when a client's vendor review arrives.
  • Staff using personal email or USB drives with borrower files.
  • Unlimited liability for missed liens in client contracts.
  • No E&O insurance.
  • Handling or relaying wiring instructions.
  • Ignoring the 1099-NEC for US field abstractors.

Frequently asked questions

Can I start a title search company for US clients from India without visiting? Yes. The company, EIN and US bank account are all set up remotely.

Do I need an SSN or ITIN for the EIN? No. Foreign owners apply on Form SS-4.

Do I need a licence to do title searches for US title agencies? Usually not, when licensed agents and attorneys rely on your searches under their own licences. Some states license abstractors who sell directly.

Will my US LLC pay US tax on title search fees? Usually not, if the work is done abroad and there is no US office or staff. It still files Form 5472. Heavy use of US field searchers is worth reviewing.

Do title agencies require SOC 2 from vendors? Larger agencies and underwriters sometimes do. Most start with a security questionnaire under ALTA Best Practices.
